The Bylaws and Declaration of Covenants are legally binding governing documents recorded with Waukesha County. Even when a proposed amendment has membership support, the board must have the new language reviewed by counsel before adopting or recording it. Bylaws

The HOA's internal operating rules — board structure, elections, meetings, voting procedures.

Amendment procedure

Changing either of Fox River View's governing documents is a deliberate process. The thresholds below come straight from the documents themselves — they aren't board policy, they're requirements every homeowner agreed to at purchase.

Bylaws § 8.1

Amending the Bylaws

The Bylaws may be amended by the affirmative vote of at least 60% of all Lots in Fox River View — that's 54 of 90 Lots. Each Lot gets one vote; abstentions count as "no" for purposes of meeting the threshold.

Declaration § 30

Amending the Declaration of Covenants

The recorded Declaration of Covenants may be amended only with the written consent of the owners of at least 63 of 90 Lots (70%).

While any Lot is still owned by Harmony Homes, Inc. (the original developer), the Declaration also requires the Developer's written consent. Confirm Harmony Homes no longer owns any Lot before launching a signature campaign.

Legal review & recording are required before an amendment takes effect.

Reaching the vote threshold is necessary but not sufficient. Bylaw amendments must be formally adopted by the board after legal review; Declaration amendments must additionally be recorded with Waukesha County before they're enforceable. Plan on a 2–4 week review window between the closing of the vote and any board action.
